Cornwall Council has a statutory duty under section 149 of the Environmental Protection Act 1990 to seize and detain stray dogs in its area. This duty means that the Council have to provide sufficient facilities to house stray dogs that are collected by its officers and by its contractors before they can be reunited with their owners or re-homed.
